The trucking industry is essential to the US economy, with the American Trucking Association (ATA) reporting that the industry moved11.27 billion tons of freight in  2024. That number is expected to increase by >1.5% in 2025.

Below is a key trends to watch with this growing industry:

The industry has experienced significant social inflation; the rising cost of insurance claims due to increased litigation, broader definitions of liability and more friendly legal environments.

The American Transportation Research Institute reported that trucking verdicts have increased by more than 50% each year for the past decade, with nuclear verdicts in the sector doubling during this time frame. As a result, the average statutory closed claim payment for commercial auto liability cases increased by 39% between 2019 and 2023.

The rise in nuclear verdicts is driving more attorneys to take cases to trial, prolonging litigation and increasing defense costs. Third-party litigation funding further fuels this trend by covering plaintiffs’ legal expenses in exchange for a share of the settlement, leading to more lawsuits and higher payouts—sometimes reaching seven figures.

As a result, commercial auto insurers are either raising premiums, restricting coverage, or exiting the market, leaving trucking companies with higher costs and potential financial strain. While state-level tort reform may offer some relief, litigation challenges are expected to persist in 2025.

To mitigate risks, trucking companies should focus on accident prevention by enhancing driver training, maintaining vehicles, enforcing safety policies, and complying with regulations. Documenting these efforts may also help secure better insurance rates and coverage options.
